• Preventive and Advisory Assistance in Employment and Labor Law

Our advisory practice in labor and employment law is aimed and applying Labor and Employment Law in a preventive manner.

These are some of the activities we carry out in this specific area:

  • advice on practices and processes of Personnel and Human Resources Departments;

  • drafting of legal opinions on the application of Labor and Employment Law;

  • assistance in the trade union framing of the company;

  • compliance and auditing internal practices for risk mapping and contingency, which could be destined or not to merger and acquisition processes of companies, or even as a feasibility study for cost and expense reduction;

  • development of careers and salaries plans and tables;

  • drafting of internal rules, compliance manuals and Human Resources and Personnel policies;

  • drafting of agreements in general, such as employment agreements including foreign employees, executives, household employees, rural employees, services agreements from self-employed providers, agency agreements, among others;

  • analysis of salary policies, payroll and utility programs and alternatives for taxation unburden of payroll;

  • assistance in the development of preventive measures for the purposes of inspection by the Employment Inspection Secretary Office and by the Office of the Federal Employment Attorneys, supplying legal advice on its developments and also for eventual notices of violation;

  • participation in collective bargaining, drafting of collective bargaining agreements and interpretation of collective rules;

  • general advice related to practical and punctual situations involving employment law matters, including disciplinary procedures of employees and the provision of outsourced services;

  • advice on legal and procedural feasibility of filing lawsuits and the risks involved, be it for individuals or legal entities.
